5. Review of Allegations: Dean

For allegations of academic misconduct for which a hearing before the President’s Advisory Committee on Student Discipline had started by September 6, 2022, the previous version of the provisions as they existed prior to the revisions apply, and that prior version can be found here: https://archive.calendar.ubc.ca/okanagan/2223/index.html.

5.1 When an allegation is reported to the Dean, the Dean must determine if the student has received any prior warning letters and must also contact the President’s Committee to ascertain if the student has a previous academic misconduct record at UBC.

5.2 The Dean will review the allegations, which may include reviewing the matter further and gathering additional information. If the student has not been given an opportunity to respond to the allegations and discuss any extenuating circumstances with the instructor, the student will be given an opportunity to respond to the allegations and discuss any extenuating circumstances with the Dean.

5.3 If, after this review, the Dean concludes that the student did not commit the misconduct, then the matter will be closed and the student will be advised of that fact and, the allegations will not be considered if any subsequent allegations of academic misconduct are made against the student.

5.4 If, after this review, the Dean concludes that the student committed the misconduct and the student does not have a previous academic misconduct record:

  • a. if the student has admitted committing the alleged academic misconduct, the Dean may either:
     
    i. enter into an integrity plan with the student pursuant to section 6 (where applicable);
    ii. give the student a written warning; or
    iii. if the Dean decides that an integrity plan or written warning are not appropriate in the circumstances, refer the matter to the President’s Committee. The Dean retains the discretion to enter into an integrity plan (where section 6 is applicable) where a hearing before the President Committee has not commenced; or

  • b. if the student has denied committing the alleged academic misconduct, the Dean may either:
     
    i. give the student a written warning; or
    ii. if the Dean decides that a written warning is not appropriate in the circumstances, refer the matter to the President’s Committee.

Where a warning letter is given, a record of the warning will be retained in the student’s file in the Faculty and, in the event of any further allegations of academic misconduct, the incident may be used in determining the discipline to be imposed for subsequent misconduct. The Dean will notify the President’s Committee and the instructor in writing of the decision and provide a copy of the warning letter to the President’s Committee.

5.5 At the conclusion of this review, the Dean will advise the student in writing of the outcome of the review.

5.6 For the purposes of this section 5, a student’s academic misconduct record includes the following:

  • a. warning letters;

  • b. integrity plans;

  • c. allegations of academic misconduct referred to the President’s Committee that have yet to be determined; and

  • d. findings of academic misconduct by the President’s Committee and the President’s decision letters as to the appropriate discipline, if any.
